Services provided by Hamnett Tech Hosting ("www.hamnett-tech.org") may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any North American federal, state, provincial or city law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute.

The subscriber agrees to indemnify and hold harmless Hamnett Tech Hosting from any claims resulting from the use of service which damages the subscriber or any other party.

By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.

Refusal Of Service

We reserve the right to refuse, cancel or suspend service, at our sole discretion.

Server Abuse

Any attempt to undermine or cause harm to a server or customer of Hamnett Tech Hosting is strictly prohibited. As our customer you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be cancelled without chance of refund or the possibility of backing up your site content.

Prohibited Activities

  • Using your account to host other websites for profit. Instant Termination and Banning will follow. See the "Reselling Policy" below this section.
  • Using 25% or more of system CPU resources for longer then 60 seconds. CGI scripts, FTP, PHP, HTTP, etc. can cause this if your coded pages have errors.
  • Adult Content (Illegal or legal)
  • Topsites
  • IRC Scripts/Bots
  • Proxy Scripts/Anonymizers
  • Pirated Content
  • Image Hosting Scripts (similar to Photobucket or Tinypic)
  • AutoSurf/PTC/PTS/PPC sites
  • IP Scanners
  • Bruteforce Programs/Scripts/Applications
  • Mail Bombers/Spam Scripts
  • Banner-Ad services (commercial banner ad rotation)
  • File Dump/Mirror Scripts (similar to rapidshare)
  • Commercial Audio Streaming (more than one or two streams)
  • Escrow/Bank Debentures
  • High-Yield Interest Programs (HYIP) or Related Sites
  • Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid)
  • Sale of any controlled substance without prior proof of appropriate permit(s)
  • Prime Banks Programs
  • Lottery Sites
  • MUDs/RPGs/PPBGs
  • Hateful/Racist/Harassment/Terrorism oriented sites
  • Hacker focused sites/archives/programs
  • Sites promoting illegal activities
  • Forums and/or websites that distribute or link to warez/pirated/illegal content
  • Bank Debentures/Bank Debenture Trading Programs
  • Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)
  • Run any gaming servers such as Counter-Strike, Half-Life, Battlefield 1492, etc
  • Run any file sharing, bit torrent or other P2P network services, client or server software
  • Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons.
  • Use of any kind of distributed computing software, including but not limited to SETI@home, Node Zero and Folding@home

Reselling Policy

We do not allow account holders to resell or lease their space to others. You may host someone else's site as an addon domain but can NOT charge any fee for such nor give them access to your cpanel account. Should there be any issues, you would be responsible for contacting us with your account information for any addon domains. Violations of this will result in immediate termination of all domains under that account.

Suspension/Termination Policy

Hamnett Tech Hosting reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice.

Refunds

Exchange rate fluctuations for international payments are constant and unavoidable. All refunds are processed in U.S. dollars, and will reflect the exchange rate in effect on the date of the payment. All refunds are subject to this fluctuation and Hamnett Tech Hosting is not responsible for any change in exchange rates between time of payment and time of refund.

Hamnett Tech Hosting gives you an unconditional 30 day money back guarantee on hosting for any customer who paid the first invoice with 2Checkout, PayPal or Paysius (Bitcoins).

All domain name registration and renewal purchases are non-refundable. Hamnett Tech Hosting is not responsible for domain names registered with spelling mistakes. All domain names that were registered for free as a promotion for purchasing a year of hosting from Hamnett Tech Hosting are also non-refundable.

Cancellations requested after the initial 30 days for hosting accounts will go into effect on the renewal date for that particular hosting package. Unless specifically requested, the account will remain active until the period expires. If the account is eligible, any request for a refund outside of the initial 30 day period will be given on a prorated basis with any previous extended term discount withheld. Refunds are to be determined once the account has been cancelled. Payments that are older than 60 days and/or sent via Paysius (Bitcoins) may require a refund via PayPal due to our merchant account policies and procedures.

Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us. Violations of the Terms of Service will waive the refund policy.

End User Profile

It is the account holder's responsibility to ensure all contact information is kept up to date for Hamnett Tech Hosting records. If an account holder, at any time, provides false or fraudulent information required by Hamnett Tech Hosting, the account is terminated.

Backups & Data Loss

We are not responsible for your data loss. We do not provide automatic server backups for our web hosting accounts. Backups can be generated within the end user's control panel. Hamnett Tech Hosting does not guarantee it will be the exact file you need. the end user agrees to create and store his or her own back ups.

Domain Names

Hamnett Tech Hosting is not responsible for any charges related to transferring domain names. Customers who purchase one or more years of hosting from Hamnett Tech Hosting are entitled to one free .com, .org, .net, .info, .biz, .us, .ca or .co.uk domain name. The domain name will be renewed at the end of the year at no cost if the customer renews their hosting plan for another year.
